The strong legal background of the firm’s partners enables them to legally analyze
the Migration Act, Regulations and Procedure Advice Manual and apply them to the
certain facts of a given client’s case.
Australia has a highly complex and legalistic visa system which requires applications
to be carefully prepared in accordance with the legal requirements. We provide a
comprehensive legal submission to accompany your application for a visa. This legal
submission will address each regulation and how you satisfy that regulation. The
application form only gives your basic details, and it does not show that you satisfy
all relevant regulatory criteria as set out in the regulations, Act and Department’s
Policy Guidelines. The legal submission comprehensively demonstrates that you satisfy
each and every regulatory and legal visa criteria.
Beside our legal approach, Alborz Consulting offers the highest standards of professionalism
such as:
- Professional assessment of migration options with application of laws to the facts
having regard to all the relevant facts of a client.
- Assistance in preparing migration applications with attention to details. As details
are very important in the migration law and incorrectly completed application forms
will not only delay your application by months but may also lead to a refusal.
- Checking of documentation to lodge a complete application which is ready for decision
by the officer and this can accelerate the process.
- Preparation of a comprehensive legal submission addressing each regulation and how
you satisfy that regulation.
- Necessary follow-up with the Immigration Department in a professional manner.
- Communication with the clients and informing them all the steps involved in a process
of applying for a visa in a timely manner. We remain available to answer your calls
and email, and will keep you updated on the progress of your case.
- It is the policy of Alborz Layers to accept clients only where it is satisfied that
there are realistic prospects of a successful application. We do not accept cases
which have no chance of success. Because of the nature of immigration law, which
involves interpretation by the Department of Immigration, no guarantee of success
can ever be given. Where a chance of failure is identified, this is fully discussed
with the client.
- Operation in accordance with a detailed
Code of Conduct. The Migration Agents Code of Conduct is authorised by the requirements
of the Migration Agents Regulations 1998 No. 53, Schedule 2, Regulation 8 and the
Migration Act 1958 Subsection 314(1). This provides protection to clients of Registered
Migration Agents. You can obtain a copy of the Code of Conduct here.
- If you are required to attend an interview we can coach you. The interview stage
is generally the final stage in your application. If all goes well in the interview
you will be granted your visa. It is sad and frustrating that many people are refused
on the grounds of something they accidentally said in the interview. Our coaching
and attendance in the interview will help prevent this tragedy from happening to
you.
- Challenging an unfavorable decision reached by the Department in case that the decision
is reviewable.
